WHAT’S COVERED? WHO’S COVERED? HOW LONG?

Interstate Wholesale Fence (IWF) offers a limited lifetime warranty on P.V.C. White, Tan, Gray, Adobe colors only, and a (20-year) Limited warranty on Pro Infused wood-grain products, Cedar, Cypress, Sandstone, Glacier, and Raven Black. This warranty extends only to the original purchaser and is non-transferable. Subject to the conditions and limitations listed herein, (IWF) warrants its vinyl fence products to be free from defective workmanship and materials and, when subject to normal and proper use, against surface peeling, rot, ground insects, splitting, corrosion, flaking, rusting and blistering, abnormal weathering, or abnormal discoloration. (IWF) warrants only those products manufactured by it. This warranty does not cover the cost of installing any product, the cost of removing or disposing of any product, or the cost of installing any replacement product furnished under the terms of the warranty. Gates will be covered for 90 days against manufacturer’s defects or clean weld failure due to stress-related cracks that happen under normal usage. Gates must be properly secured during exposure to storm-related winds. If blown backward due to a lack of proper securing, stress will result, causing fracture and/ or weld separation that will not be covered under warranty. Notwithstanding the foregoing, gates and double-drive gates up to Sixty (60) Inches (Five [5] Feet per leaf), or two (2) leaves with a maximum opening of Ten (10) Feet, shall only be covered for Ninety (90) Days against manufacturing defects or clean weld failure due to stress-related cracks occurring under normal usage. There is no warranty for gates or removable sections and double drive gates with a larger span set forth in the previous sentence. The warranty period begins on the date of product installation.

WARNING

(IWF) Employees are not qualified to approve, recommend, or advise as to the suitability of Interstate Wholesale Fence Products for all possible uses or applications. No distributor, dealer, or other person is authorized by (IWF) to change this warranty or to make any additional representation, warranty, promise, guarantee, or other assurance on behalf of (IWF). (IWF) products cannot be expected to contain large animals (including but not limited to horses), and therefore, (IWF) makes no representation about and does not warrant against the failure or breach of any such containment.

CLAIMS AND REMEDIES

To submit a Warranty claim, the purchaser must notify the original company of purchase within thirty (30) days of discovering, or of when the defect reasonably could have been discovered. Such notification must include photographs, proof of purchase (invoice), proof of Warranty, and any documentation necessary for submission to Interstate Wholesale Fence (IWF).

IWF shall be afforded a reasonable period of time to inspect the product or, at IWF’s sole option, to require that the product be shipped—at the owner’s expense, prepaid—to Interstate Wholesale Fence for examination of the alleged defect. IWF shall be the sole judge of whether the product is defective and whether such defect is due to manufacturing. If, after inspection, IWF determines that the claim falls within the terms and conditions of this Warranty, IWF shall, at its sole discretion, repair or replace the defective section or part.

LIMITATIONS

IWF’s obligation under this Warranty is expressly limited to the repair or replacement of products found to be manufactured with defects. In the event of repair or replacement under the terms of this Limited Warranty, the original Limited Warranty shall apply to the repaired or replaced product and shall continue in effect for the remainder of the original Limited Warranty period only. The coverage afforded by this Limited Warranty shall automatically terminate upon the earlier occurrence of either the sale or transfer of the property on which the product was originally installed, or the death of the original purchaser.

EXCLUSIONS

(IWF) shall not be liable for, and this warranty does not apply to any failure, defect, or damage resulting from or connected with the following: Installation or handling of products after they leave our factory, including any lack of performance or improper performance in any way by the contractor or other installer. Abnormal use of the products. The application of paint, varnish, or other coating or chemical not approved by (IWF). Any lack of compatibility between our products and any other product not manufactured by us that causes damage to or failure of our products. Labor, transportation, or installation costs. Color or pattern variance between any new replacement section or profile and other sections or pieces. (We reserve the right to discontinue or modify any product line or color without notifying the original purchaser. If the original product is not available, we retain the right to choose to provide replacement material of equal value or quality.) Fading, color change, or color match on any variegated profiles or accessories. This includes but is not limited to the following colors: Cedar, Cypress, Sandstone, Glacier, and Raven Black. Damage caused by, among other things, weathering, oxidation, mold, mildew, settling of the building, failure of the structure (including foundations and walls), use of incompatible accessories, fire, flood, lightning, ice, freezing, wind and human – borne objects, earthquake, hurricane, sun, cyclone, gale, tornado, weather of a catastrophic nature, sprinkler systems, acts of God, intentional acts, unreasonable use, misuse, physical abuse, vandalism, Graffiti, riot, insurrection or civil disorder, accidents or corrosive atmospheres (such as those contaminated by acid rain, harmful chemicals or vapors). Color change due to weathering that is even and equal when exposed to the same or similar sunlight and other environmental conditions is excluded from the warranty because weathering will cause any colored surface to gradually lighten, darken, chalk or accumulate dirt or stains (the severity of these conditions depends on the air quality, the geographic location of the property, and other local conditions over which (IWF) has no control). Distortion, warping, or melting of the fence products due to exposure to excessive heat and heat sources, including but not limited to barbeque grills or exposure to unusual or excessive reflective heat sources (e.g., skylight or window reflection of High Performance or Low E glass, pools, decks, Blacktop, or concrete materials)

THE STATEMENTS CONTAINED IN THIS LIMITED WARRANTY SET FORTH THE ONLY WARRANTIES EXTENDED BY IWF, AND ARE IN LIEU OF ALL OTHER WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY AND WARRANTIES OF FITNESS, AND THE PROVISIONS OF THIS WARRANTY SHALL CONSTITUTE THE ENTIRE LIABILITY OF IWF AND THE PURCHASER’S EXCLUSIVE REMEDY FOR BREACH OF IWF’S WARRANTY. TO THE EXTENT PERMITTED BY APPLICABLE LAW, IWF SHALL NOT BE LIABLE TO THE PURCHASER FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES FOR BREACH OF ANY EXPRESS OR IMPLIED WARRANTY ON THE FENCE PRODUCT.
